The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding. The arbitrator shall have authority to award any remedy that would be available in a court of competent jurisdiction, including injunctive and declaratory relief on an individual basis. The arbitrator shall not have authority to conduct class-wide proceedings.

YOU AND GREEN LANTERN PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

11.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or to address other matters for which equitable relief is the appropriate remedy. Small claims court actions may also be brought by either party where the claims fall within the jurisdictional threshold of such court.
